Terms of Service & End-User License Agreement

1. Acceptance of terms

These Terms of Service (the "Terms") govern your access to and use of the website, services, and software made available by The Go Game ("we", "us", "our"), including our team-building events, our internal CRM platform, and any integrations we operate with third-party services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your internal business or personal purposes. The Services, including all related software, content, and trademarks, are owned by The Go Game or our licensors and are protected by intellectual property laws. No rights are granted other than those expressly stated in these Terms.

3. Acceptable use

• You will not use the Services in violation of any applicable law or regulation.
• You will not attempt to reverse engineer, decompile, or extract source code from the Services.
• You will not interfere with the operation of the Services, attempt to gain unauthorized access, or use the Services to transmit malware or unsolicited communications.
• You are responsible for maintaining the confidentiality of any credentials issued to you and for all activity that occurs under your account.

4. Third-party integrations

The Services may connect to third-party platforms, including but not limited to QuickBooks Online, Google Workspace, HubSpot, Stripe, and SendGrid, when an authorized administrator enables those integrations. You acknowledge that your use of any third-party platform is governed by that platform's own terms and privacy policies, and that we are not responsible for the availability or accuracy of those third-party services. You authorize us to access, store, and process data from those platforms as needed to provide the integration features you have enabled, in accordance with our Privacy Policy.

5. Bookings and payments

When you book an event or purchase Services, additional terms (including pricing, scheduling, cancellation, and refund terms) may be presented to you at the point of purchase or in a separate written agreement. Those additional terms are incorporated into these Terms by reference.

6. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE GO GAME, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold harmless The Go Game and its affiliates from any third-party claims arising out of your use of the Services or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, us, or third parties.

10. Changes to these terms

We may modify these Terms at any time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated to you directly. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of these Terms will be the state or federal courts located in San Francisco County, California.
